Your records. Clear terms.

Terms of Service

A plain-language agreement for using KPT Capture: what the pilot offers, how your records are handled, and what we each need to do.

Consolidated draft — not yet effectiveDrafted October 22, 2026

Privacy PolicyTerms of Service
Drafting complete. Not yet effective.

The drafting decisions below are complete. Dedicated contact-email setup and verified deletion/retention procedures remain pending before these policies take effect. Final legal review is recommended before adoption.

The pilot is free.

Invitation only. Two active owned properties and 100 MB of original-file storage. No card or automatic charges.

Your content stays yours.

We need permission to run the service and carry out your choices. Uploading a file does not give us ownership of it.

Review before relying.

Check AI suggestions and property estimates. KPT Capture is a notebook, not professional advice or a substitute for original records.

1. The agreement and eligibility

These Terms govern the KPT Capture website and property-notebook application operated by KPT Industries, LLC, an Arizona limited liability company. The current pilot application also uses the working name Property HQ. The Privacy Policy explains our handling of personal information. These consolidated drafts are not yet effective; once adopted, the Terms will be presented for your agreement.

Pilot access is limited to users in the United States aged 18 or older with an invitation or other approved beta access. You must have authority to enter the agreement and, if acting for a business or organization, authority to act for it.

2. The free pilot and service limits

The current invitation-only pilot is free. It includes up to two active owned properties and 100 MB of original-file storage. Sold or archived properties do not count toward the active-property limit, but their stored original files still count toward storage. Shared properties and ownership changes follow the limits shown in the application.

No payment card is required, and the pilot does not automatically convert to a paid subscription. Paid upgrades are not currently available. Any future paid plan will require a separate offer and your agreement to its price and billing terms before a charge.

Features, supported file types, request rates and provider availability can limit use. AI-read and property-check figures shown as planning or observation allowances are not a promise of unlimited processing or a paid credit balance. The pilot does not include guaranteed uptime, response times or permanent access.

3. Your account

Use an accurate email address that you control, keep your sign-in links private, and protect the Google or email account used to sign in. Tell us promptly if you suspect unauthorized access. Each person with shared property access should use their own account rather than a shared sign-in.

You are responsible for activity you authorize through your account and for choosing appropriate collaborators. You are not automatically responsible for activity caused by our own failure to meet a legal obligation.

4. Your records and our permission to process them

You retain the rights you have in the content you submit. You must own that content or have permission to store, use and share it, including personal information belonging to tenants, co-owners, contractors or other people. Keep sensitive information to what is necessary. Do not upload passwords, full payment-card details, Social Security numbers or medical records.

You give KPT Industries, LLC a non-exclusive permission to host, store, copy, process and display your content only as needed to provide, protect and support KPT Capture, maintain backups, and carry out your requested sharing, export, transfer and optional processing actions. This permission does not give us ownership or a right to sell your private records, advertise with them or train our own AI models on them.

That permission lasts while needed for those purposes, including the limited retention described in the Privacy Policy after deletion. Rights another recipient lawfully receives through your sharing or transfer are separate. KPT Capture’s software, website design and brand remain the property of KPT Industries, LLC or its licensors.

5. Collaborators, exports and transfers

Review each person’s role and every attachment before granting access. All roles with property access can open its attached files, even when some structured fields are hidden. You can revoke access, but cannot use that action to retrieve a copy someone already downloaded.

Private backups can include financial details, private notes and originals. Sale packets and transfers contain selected information, but an attachment you choose can still reveal private information. Check the final export or transfer contents before distributing them.

An accepted transfer creates a recipient’s editable copy and leaves the sender a read-only archive. A transfer inside KPT Capture transfers records only. It is not a deed, transfer of legal title, assignment of a contract, or confirmation of a property sale.

Closing the seller’s account does not automatically remove a buyer’s independent accepted transfer copy. Requests to remove personal information within that copy receive separate review under the Privacy Policy and applicable law. Removing a collaborator’s access does not close that person’s own account.

6. AI, lookups and information you rely on

AI reading is optional and sends the selected file to Google Gemini. Only request a read if you have the rights and permissions needed to send that file. Review extracted information against the original before saving or relying on it. Provider processing is described in the Privacy Policy.

Property facts, valuations and rent estimates can be incomplete, outdated or wrong. They are informational estimates, not an appraisal, inspection, guarantee of market value or rental income, or legal, tax, financial or maintenance advice. Verify important information independently and consult an appropriate professional when needed.

Do not use KPT Capture or its data to make regulated credit, employment, insurance or tenant-eligibility decisions. KPT Capture is not offered as a consumer-reporting or tenant-screening service. Keep source documents and verify safety-related work rather than relying on an AI interpretation.

7. Acceptable use

  • Use the service lawfully and respect privacy, intellectual-property and other people’s rights.
  • Do not upload malware, knowingly unlawful content or information you are not authorized to process.
  • Do not impersonate another person, attempt to access another account, bypass permissions or quotas, or interfere with the service.
  • Do not scrape other customers’ information, redistribute provider datasets without permission, send spam, or resell service access without our agreement.
  • Report suspected security issues privately and do not exploit them to access, alter or disclose someone else’s records.

8. Availability and changes

KPT Capture is an early service. Features may change, maintenance can interrupt access, and third-party providers can fail or change their services. We may adjust features and reasonable limits to protect the service. Where practical, we will give advance notice of a material reduction or discontinuation and an opportunity to export records.

Keep an independent copy of important records. Our backups support service recovery; they are not a promise to restore any particular item or a replacement for your own recordkeeping. Public sample records are fictional examples.

9. Ending access and account closure

You may stop using KPT Capture at any time and request account closure and deletion through the contact method in the Privacy Policy. Account closure is handled manually; a self-service deletion button is not currently available. We verify your identity and authority first. Signing out, revoking a share or marking a property sold does not close an account.

The following deadlines apply to the account and data you control. Routine support correspondence is kept up to 90 days after case closure, with the account-deletion deadline taking priority for linked personal information unless a narrow documented exception applies. Unsaved extraction results are cleaned up within 24 hours of completion or abandonment; saved fields follow the record/account rules.

Account deletion
Target: within 30 calendar days of receiving the request

After verifying your identity and authority, we remove the account and its owned records from active systems. Verification does not restart the clock. We explain any lawful limitation, follow applicable shorter deadlines and retain only the narrow exceptions described here.

Affected backup and recovery copies
Within 14 calendar days after active-system deletion

Access is restricted to recovery. Completed deletions must be reapplied before a restored copy returns to service. A documented legal hold or other narrow exception applies only to the specific information that must be retained.

Routine activity and security logs
Up to 90 days from the event

The 30-day account-deletion deadline takes priority for account-linked personal logs unless a documented approved exception applies. Copying or exporting a log does not restart its retention period.

Minimal privacy-request record
24 months after our final response

We retain a request reference, the minimum account/requester reference needed, request date/type/method, verification outcome, response date/outcome and any basis for a denial. This restricted compliance record does not include your property library, original uploads or identity-document copies merely as proof of handling. We delete it when the period ends unless a documented lawful exception requires longer.

We do not automatically delete saved property records merely because an account is inactive or the pilot ends. This pilot rule is not a promise of perpetual storage for a future public or paid service. We will give appropriate advance notice and an export opportunity before a new inactivity cutoff or a planned service closure, where lawful and practical.

A recipient’s independent accepted transfer copy is retained under the recipient account’s rules; requests about personal information in that copy are assessed separately. Browser drafts and downloaded copies outside our service are not erased by closing a server account.

We retain only specific information needed for a documented legal obligation, actual fraud/security investigation or active dispute. Access and use are restricted to that purpose, the need is reviewed and the information is deleted when it ends. Any required longer retention for a minimal privacy-request record is handled on that same documented basis.

We may restrict or suspend access for a material violation, security threat, unlawful activity or legal requirement. Where practical and lawful, we explain the reason and offer a way to resolve it. Immediate action may be necessary to protect people or data. Closure, suspension or the pilot ending does not create an automatic charge. Terms needed to resolve existing rights or disputes continue only as permitted by law.

10. Warranties and legal rights

To the extent allowed by applicable law, KPT Capture is provided as available and without warranties of uninterrupted operation, error-free information or fitness for a particular purpose. We cannot guarantee that a third-party estimate, AI result or customer-supplied record is correct.

These Terms do not exclude rights, guarantees or remedies that the law does not allow us to exclude, and do not excuse us from applicable privacy or security duties.

11. Limits on liability

To the extent permitted by applicable law, neither party is liable to the other under these Terms for indirect or consequential losses, such as lost profits, arising from use of the service. The total aggregate liability of KPT Industries, LLC for service-related claims is limited to the greater of US $100 or the KPT Capture fees you paid in the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply to fraud, intentional misconduct, gross negligence or any responsibility that applicable law does not permit a party to limit. They do not exclude mandatory consumer remedies or non-waivable privacy, security or other legal obligations.

12. Questions, disputes and applicable law

Please contact KPT Industries, LLC so we can try to resolve a concern. Contacting us first is not a condition for using a statutory right or remedy and does not suspend a legal deadline.

Arizona law governs these Terms, except where mandatory law gives you protections that cannot be displaced by this choice. Disputes may be brought in a court with lawful jurisdiction. These Terms do not require exclusive use of a Maricopa County court and do not waive a legally protected right to bring a claim in another competent court.

These Terms do not require binding arbitration, waive class actions or require you to give up a mandatory consumer right.

13. Updates and contact

The adopted Terms will show an effective date and version. We will give reasonable notice of material changes through the application or account email and obtain agreement where required. Changes will not retroactively remove rights for an existing dispute or silently expand uses of previously collected personal information.

If a provision cannot be enforced, the remaining provisions continue to the extent allowed by law. These Terms and any additional terms you expressly agree to govern the service; an unaccepted future pricing proposal is not a subscription agreement.
